As of 6am this morning there is no smoking in enclosed spaces, which includes pubs and even company cars.
I'm not sure if it's been made clear enough as it is just refered to as "the smoking ban", so I can see people in the street being "got at" by passers by when they light up.

so if someone is smoking who will impose the fine on them, members of the public or a passing policeman, its not very clear is it.

I think they are relying on members of the public to "inform" on pubs, clubs etc. that allow their customers to smoke.
Apart from that I don't see how they can police it because there just isn't enough police on the beat to fight "real crime" let alone police clubs, pubs, eating houses etc. to fine people who are smoking.
I don't go anywhere so it won't affect me.
(I am a smoker by the way. Couldn't get by without them.)
